You should you buy JSX if:
- JSX costs less than reinventing and maintaining your own solution in-house
- JSX meets your needs better than alternative products
- you need a proven solution that definitely works
- you need it today
- you need the intellectual property rights assurance of an IP indemnity

License Terms
(1).	Definitions
You - the person or company who wishes to download and evaluate JSX.
JSX - the software "Java Serialization to XML" created and owned by JSX Enterprises and available for download at www.jsx.org/download.html

(2).	Evaluation Period
You may use JSX for an evaluation period of up to 30 days for the sole purpose of internally evaluating it. Your evaluation period begins when you first download JSX. Any use of JSX beyond the evaluation period requires purchase of JSX. You agree that on or before the end of the evaluation period, you will either pay the required license fee for a Commercial License, or cease using JSX and delete JSX from your system.

(3).	No distribution
You may not distribute JSX or make copies of it. (You may refer others to the JSX website to obtain their own copy: www.jsx.org)

(4).	Not reverse engineer or decompile
You may not reverse engineer, decompile or otherwise attempt to reconstruct or discover the source code from the class files of JSX except to the extent applicable laws specifically prohibit such restriction.

(5).	Non compete
Your application of JSX must not compete with JSX - JSX must be used only as a minor component, embedded, in a supporting role, incidental to the primary function of your application. The JSX API (or functional equivalent) must not be exposed to the user of the application. 

(6).	Trademark and copyright notices
You may not remove any product identification, copyright, trademark, proprietary notices or labels from JSX.

(7).	Warranty
JSX is provided on an "as is" basis, and no liability is accepted whatsoever for any damage caused by the use of JSX. JSX certainly contains some bugs, as all software does. 

JSX Enterprises SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARANTIES OF MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND ANY IMPLIED WARRANTY ARISING FROM COURSE OF PERFORMANCE OR COURSE OF DEALING. 

(8).	Liability
IN NO EVENT WILL JSX Enterprises BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, EXEMPLARY, SPECIAL, OR INCIDENTAL DAMAGES, INCLUDING ANY LOST DATA OR LOST PROFITS, ARISING FROM OR RELATING TO THIS AGREEMENT, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. JSX Enterprises' TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THIS AGREEMENT AND THE LICENSED SOFTWARE, WHETHER IN CONTRACT OR TORT OR OTHERWISE, WILL NOT EXCEED THE PAYMENTS MADE BY YOU UNDER THIS AGREEMENT FOR THE SPECIFIC SOFTWARE WHICH CAUSED THE DAMAGES. YOU ACKNOWLEDGE THAT THE FEES DUE HEREUNDER REFLECT THE ALLOCATION OF RISK SET FORTH IN THIS AGREEMENT AND THAT JSX Enterprises WOULD NOT ENTER INTO THIS AGREEMENT WITHOUT THESE LIMITATIONS ON JSX Enterprises' OWN LIABILITY, AND THE PRICE WOULD HAVE BEEN MUCH HIGHER (THAN FREE) TO COVER INSURANCE COSTS. 

Explanatory Note: Because JSX is a java component, licensed for the purposes of embedding within your own product, and so is being sold into an industrial market, it is not being sold in a "consumer" market. Therefore this license is not expected to fall under any "consumer protection" legislation relevant to your jurisdiction, and so not implying warranties such as "fitness for purpose" and "merchantability" etc. However, in the event of any such warranties, conditions or other terms being implied, they are limited by the above warranty and liability terms.

Note: Any liability found is limited to the purchase price, by the liability term. 

(9).	Termination
Breach of these terms causes immediate termination of your right to use JSX.

(10).	Laws governing
This License will be construed under the laws of the State of Victoria, Australia. 

(11).	Jurisdiction
The Supreme Court of Victoria, Australia, has jurisdiction over this license, and all matters arising under it. 


Note: This evaluation license has no IP INDEMNITY nor WARRANTY as to rights. These are available in the commercial license.
